These Terms of Service ("Terms") apply to your use of brainmaxe.com and its games (the "Service"), operated by Dynavor International, [Country — to be confirmed] ("Brainmaxe", "we", "us"). By using the Service you agree to these Terms.
1. Your account
- You sign in with a Google account. One Brainmaxe account per person.
- You must be at least 13 years old, and have a parent's permission if you are under the age of majority where you live.
- You are responsible for activity on your account. Tell us straight away if you think it has been misused.
2. Free trial
Each new account receives a one-time free trial of 10 minutes of play. The trial cannot be reset, transferred or exchanged for credits or cash. Creating extra accounts to get more free trials is not allowed.
3. Credits
- Credits are a digital product that unlocks play-time on Brainmaxe. 1 credit = 1 minute of play unless shown otherwise at purchase.
- Credits are deducted while a game session is running, as measured by our servers.
- Credits have no cash value, cannot be withdrawn or exchanged for money, and cannot be transferred to another account.
- Credits do not expire while your account is active.
- Prices are shown in USD before you pay. All purchases are one-time payments; there are no subscriptions.
4. Payments
Payments are processed by PayPal under PayPal's own terms. Credits are added to your account once PayPal confirms the payment. If a payment is reversed, charged back or refunded, we may remove the related credits from your account.
5. Refunds
Refunds are handled under our Refund & Cancellation Policy.
6. Acceptable use
You agree not to:
- cheat, tamper with the play-time meter or credit balance, or exploit bugs;
- use bots, scripts or automated tools to play or to create accounts;
- copy, modify or redistribute our games or website content;
- interfere with the security or operation of the Service;
- use the Service for anything illegal.
7. Games and content
Games on Brainmaxe may be created by third-party developers and licensed to us. We may add, change or remove games at any time. All content on the Service is owned by us or our licensors.
8. Suspension and termination
We may suspend or close accounts that break these Terms, for example for cheating, fraud or payment abuse. You can stop using the Service and ask us to delete your account at any time. Unused credits on an account closed for a breach of these Terms are not refunded.
9. Disclaimers
The Service is provided "as is" and "as available". We work to keep it running smoothly but do not promise it will always be available or error-free. If a technical fault on our side uses your credits incorrectly, contact us and we will put them back.
10. Limitation of liability
To the extent allowed by law, our total liability to you for any claim relating to the Service is limited to the amount you paid us in the 12 months before the claim. We are not liable for indirect or consequential losses. Nothing in these Terms limits rights you have under consumer law that cannot be excluded.
11. Changes to these Terms
We may update these Terms. We will post the new version here and change the "Last updated" date. If you keep using the Service after a change, the new Terms apply.
